[RealEdge] HDB Circular: Subletting of Flat/Rooms to Non-Malaysian Foreign Construction Workers

SUBLETTING OF FLAT/ROOMS TO NON-MALAYSIAN FOREIGN CONSTRUCTION WORKERS


1       Previously, under HDB's Subletting of Flat/Room Scheme, subtenants can be Singapore citizens, Singapore permanent residents and non-citizens legally residing in Singapore. For non-citizen subtenants, they can be holders of employment passes, work permits or student passes. There is no restriction on the nationality of subtenants and the industry in which they are employed.

2        HDB has revised the eligibility conditions for subtenants under the Subletting Scheme. From 7 Nov 2006, non-Malaysian foreign construction workers who are work permit holders are not eligible to rent a flat or room from HDB flat owners.  

3        The revision is in line with the governmentÂ’s plan to house foreign construction workers in purpose-built dormitories or workersÂ’ quarters constructed on land that is approved for off-site housing.

4        Flat owners who are currently subletting their flats to non-Malaysian foreign construction workers are allowed to continue to sublet their flats to these workers until the existing subletting approval expires, or up to 6 Nov 2007, whichever is earlier. Thereafter, they will have to ensure that the workers move out of their flat. Similarly, those who are currently subletting their rooms to non-Malaysian foreign construction workers can continue to do so until 6 Nov 2007.

Annex

ELIGIBILITY OF SUBTENANTS

The list of permitted and non-permitted subtenants is shown below :

Permitted Subtenants

-    Singapore citizens; and
-    Non-citizens who are legally residing in Singapore (e.g. holders of Singapore blue identity cards, valid work permits, employment passes and student passes)

Non-Permitted Subtenants

-     Non-Malaysian foreign construction workers;
-     owners or tenants of existing HDB flats, except for :
           
a)  owners/tenants who are divorced/legally separated;
            b)  owners who are given approval to sublet their own HDB flat.
-     owners of existing Executive Condominium units where the 5-year minimum occupation period has not been met.
